New Construction or Existing Home ; What Is the Difference?
Hello, this is Yatsuka from Anhome (Follow-Up Inc.).
■ "New" Has a Legal Definition in Japan
The words "new" and "used" or "existing" are used freely in property searches, but in Japan, "new construction" has a legal definition. A property qualifies as new only if it was built less than one year ago and has never been occupied. Once a property is more than a year old, or has been lived in even briefly, it can no longer be advertised as new construction. Knowing this distinction sharpens how you read property information.
■ Characteristics of New Built-for-Sale Homes
New built-for-sale homes are sold as a package of land and building. The building may already be complete, or it may still be under construction at the time of sale. When purchasing before completion, there are cases where some aspects of the layout or specifications can be chosen, and cases where they cannot.
By law, the seller of a new home carries a ten-year liability for defects in key structural elements the foundation, load-bearing structure, and protection against water infiltration, among others. This obligation begins from the handover date.
■ Characteristics of Existing Homes
Existing homes are properties that were built some time ago, or that have previously been occupied. As a general tendency, they are priced lower than new construction of comparable size and location though this varies considerably depending on the property's condition, age, and specific location.
During a viewing, you can see the building as it actually exists and has been used. That direct visibility can be useful when evaluating the property. At the same time, wear on fixtures and fittings, and the potential cost of any renovation, should be factored into the overall budget.
The terms around defect liability differ from new construction and can vary depending on whether the seller is an individual or a company. Reviewing the contract terms carefully is important.
■ Which to Choose Depends on Your Situation
Whether new or existing construction suits you better depends on budget, the condition you are looking for, interest in renovation, and what is available in your target area. General statements like "new is safer" or "existing is better value" do not hold across all situations. The right answer comes from looking at specific properties and comparing their actual terms and conditions with your needs.
