今日は、「自分の代わりに、家族に売却の手続きを進めてもらいたい」というご相談があったときに、実際どんな準備が必要になるか、というお話をします。

Today's topic is something that comes up more than people expect: wanting a family member to handle the sale of a property on your behalf. Here's what actually needs to be in place for that.
■ 「家族だから大丈夫」では進まないことがある
高齢の親御さんの代わりに、お子さんが手続きを進めたい、といったご相談をいただくことがあります。ただ、家族だからという理由だけでは、売却の手続きはそのまま進みません。売主本人の意思にもとづいて行われる取引であることを、きちんと確認できる形にしておく必要があります。
■ Being family isn't automatically enough
We sometimes hear from someone wanting to handle a sale on behalf of an elderly parent, for example. But being a family member alone doesn't let the process move forward on its own. The transaction still needs to be clearly grounded in the actual seller's own intent, in a way that can be properly confirmed.
■ 代理を立てるときに必要になる書類
本人（売主）側では、委任状や本人確認書類が必要になります。代理人側にも、本人確認書類や、場合によっては続柄が分かる書類が求められます。委任状には、何を、どこまで任せるのかが具体的に書かれている必要があり、内容があいまいだと、手続きの途中で確認が止まってしまうことがあります。
■ The documents typically needed for a proxy sale
On the seller's side, a power of attorney and identity documents are generally required. The person acting on their behalf also needs identity documents, and sometimes proof of the family relationship. The power of attorney needs to clearly spell out exactly what's being delegated and how far that authority goes if it's vague, the process can stall partway through while that gets clarified.
■ なぜ本人への直接確認が入るのか
書類がそろっていても、本人の意思を直接確認する場面が入ることがあります。これは代理人や家族を疑っているということではなく、契約が本人の意思にもとづいていることを、第三者の立場からも確認できるようにするためです。特にご高齢の方が売主の場合、この確認がより丁寧に行われることがあります。
■ Why direct confirmation with the seller still happens
Even with all the paperwork in order, there's often still a step where the actual seller's intent is confirmed directly. This isn't about distrusting the family member acting on their behalf it's about making sure, from a neutral standpoint, that the contract genuinely reflects what the seller wants. This step tends to be handled with extra care when the seller is elderly.
■ 進める前に知っておきたいこと
必要な書類や確認の流れは、状況や取り扱う不動産会社によって多少異なります。「前にこうだったから今回も同じはず」と思い込まず、早い段階で担当者に相談し、何がいつまでに必要になるかを確認しておくと、手続きがスムーズに進みやすくなります。
■ Worth knowing before you start
The exact documents and confirmation steps can vary somewhat depending on the situation and the real estate company involved. Rather than assuming "it worked a certain way before, so it'll be the same this time," it helps to talk to someone early and confirm what's needed and by when that tends to make the whole process go more smoothly.
